Welcome to Moodscape Shop. These Terms & Conditions (the “Terms”) govern your access to and use of our website at www.moodscapeshop.com (the “Site”) and any purchases you make from us through the Site.
By visiting the Site, placing an order, or otherwise using our services, you agree to be bound by these Terms. If you do not agree, you may not use the Site or purchase our products.

By using the Site and/or placing an order, you represent that:
You are at least 18 years old (or the age of legal majority in your jurisdiction); and
You have the legal capacity to enter into a binding contract; and
You will use the Site in accordance with these Terms and all applicable laws.
If you are using the Site on behalf of a business or other entity, you represent that you are authorized to accept these Terms on its behalf.
3. Changes to These Terms and the Site
We may update these Terms from time to time. When we do, we will update the “Last updated” date at the top of this page.
Your continued use of the Site after any changes become effective means you accept the revised Terms. If you do not agree, you must stop using the Site.
We may also modify, suspend, or discontinue any part of the Site (including product offerings) at any time without prior notice.
4. Use of the Site
You may use the Site only for lawful purposes and in accordance with these Terms.
You agree not to:
Use the Site for any illegal or unauthorized purpose;
Interfere with or disrupt the Site or servers/networks connected to the Site;
Attempt to gain unauthorized access to any portion or feature of the Site, or to any systems or networks connected to the Site;

We reserve the right to terminate or suspend access to the Site (or your account) at any time if we believe you have breached these Terms or are using the Site in a harmful or unlawful way.
5. Products and Services
5.1 Product Descriptions
We aim to describe and display our products as accurately as possible. However:
Colors may appear differently on different screens and devices.
Because many of our products are produced on-demand, minor variations may occur in size, color, or placement of design elements.
We do not warrant that product descriptions, images, pricing, or other content on the Site are error-free, complete, or current. If you believe a product you received is materially different from its description, please contact us as described in our Shipping & Returns policy.
5.2 Availability
All products and prices are subject to availability and may be withdrawn or changed at any time.
We may limit the quantity of products that you can purchase, reject all or part of an order, or cancel an order even after it has been submitted if we cannot fulfill it (for example due to stock, technical errors, or suspected fraud). If we cancel an order, we will refund any amounts paid for that order.
5.3 Print-on-Demand Fulfillment
Moodscape Shop works with third-party print-on-demand and fulfillment partners to produce and ship many of our products.
By placing an order, you acknowledge that:
Your order may be fulfilled and shipped directly by our selected fulfillment partner(s); and
Your shipping information will be shared with them solely for the purpose of fulfilling your order.
6. Account Registration
You may be able to create an account on the Site. If you create an account, you are responsible for:
Providing accurate and current information;
Keeping your login credentials confidential; and
All activities that occur under your account.
You must notify us immediately if you suspect any unauthorized access or use of your account.
We reserve the right to suspend or terminate accounts that are inactive for an extended period or that we believe are being used in violation of these Terms.
7. Orders and Payment
7.1 Placing Orders
By placing an order through the Site, you are offering to purchase a product:
At the price displayed (plus applicable taxes, duties, and shipping), and
Subject to these Terms and any additional terms presented at checkout.
An order is considered an offer, and we are not obligated to accept it. We may decline or cancel any order, including after you have received an order confirmation, if:
The product is unavailable;
There is an error in price or product information;
We suspect fraud or unauthorized activity; or
We otherwise believe the order cannot be fulfilled.
If we cancel an order after you have been charged, we will refund the applicable amount.
7.2 Prices and Taxes
All prices on the Site are shown in the currency indicated and do not necessarily include taxes, customs duties, or shipping fees, unless expressly stated.
Applicable taxes and shipping costs will be calculated and displayed during checkout, based on your shipping address and order details.
If your order is shipped internationally, you may be responsible for customs duties, import taxes, and other fees imposed by your country’s authorities.
We may change prices at any time. Changes do not affect orders that have already been accepted.
7.3 Payment Methods
We accept the payment methods displayed at checkout (e.g., major credit/debit cards, digital wallets, etc.), processed by third-party payment providers.
By submitting payment details, you represent that:
You are authorized to use the chosen payment method; and
You authorize us (and our payment processors) to charge the total amount of your order.
We do not store full payment card details on our systems. Payment processing is subject to the terms, conditions, and privacy policies of our payment processors.
8. Shipping, Delivery, Returns & Refunds
8.1 Shipping & Delivery

Delivery times are estimates only and not guaranteed. Factors such as production times, carrier delays, customs operations, and local conditions can affect actual delivery. We are not liable for delays outside our reasonable control.
Risk of loss passes to you when the order is delivered to the address you provided, or as otherwise required by applicable law.
8.2 Returns, Exchanges, and Refunds
Our policies regarding returns, exchanges, and refunds are described in detail on our Shipping & Returns page. This page explains:
Which products are eligible for returns or exchanges;
Time limits and conditions for returns;
Who is responsible for return shipping costs; and
How refunds are processed.
Please review that policy carefully before purchasing. By placing an order, you agree to the return and refund terms described there.
Nothing in these Terms or our Shipping & Returns policy affects any non-waivable statutory rights you may have under applicable consumer protection laws.
9. Promotions, Discount Codes, and Gift Cards
From time to time, we may offer promotions, discount codes, or other special offers. These may be subject to additional terms and conditions, which will be made available at the time of the promotion.
Unless otherwise stated:
Promotions cannot be combined with other offers;
They are valid only for the specified period and/or products;
They are non-transferable and have no cash value.
If you use a discount code in violation of applicable terms, we may refuse or cancel your order.
If we issue gift cards or store credit (and where permitted by law), additional terms may apply, including expiration dates and restrictions on use.
10. Intellectual Property
All content on the Site, including but not limited to:
Text, graphics, logos, icons, images, photographs, artwork, and illustrations;
Product designs and patterns;
Audio and video clips;
Software, code, and user interface elements
is owned by or licensed to Moodscape Shop and is protected by copyright, trademark, and other intellectual property laws.
You may not:
Copy, reproduce, modify, distribute, transmit, display, perform, publish, license, create derivative works from, or otherwise exploit any content on the Site without our prior written consent, except as permitted by applicable law;
Use any of our trademarks, trade names, or branding without our written permission.
You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Site for personal, non-commercial purposes in accordance with these Terms.
11. User Content (Reviews, Comments, Submissions)
The Site may allow you to submit or post content, such as reviews, ratings, comments, photos, or other materials (“User Content”).
By submitting User Content, you represent and warrant that:
You are the owner of the User Content or have all necessary rights to submit it;
The User Content is accurate, not misleading, and does not violate any law or rights of any third party (including privacy, publicity, or intellectual property rights);
The User Content is not defamatory, abusive, hateful, harassing, obscene, or otherwise inappropriate.
You grant Moodscape Shop a worldwide, non-exclusive, royalty-free, transferable, sub-licensable license to use, reproduce, modify, adapt, publish, translate, distribute, display, and perform your User Content in connection with the Site and our marketing, including on social media and other channels, in any media now known or later developed, without additional compensation to you.
We reserve the right (but have no obligation) to monitor, edit, or remove User Content that we determine in our sole discretion is unlawful, offensive, or otherwise violates these Terms.
12. Third-Party Services and Links
The Site may contain links to third-party websites, services, or content (including social media platforms, payment providers, and fulfillment partners) that are not owned or controlled by us.
We are not responsible for:
The content, policies, or practices of third-party sites or services;
Any transactions you enter into with third parties.
Your use of third-party sites or services is at your own risk and is subject to the terms and privacy policies of those third parties. We encourage you to review their terms and policies carefully.
13. Disclaimer of Warranties
To the maximum extent permitted by law, the Site and all products and services provided through the Site are offered on an “as is” and “as available” basis, without warranties of any kind, whether express or implied.
Without limiting the foregoing, we do not warrant that:

The information on the Site is accurate, complete, or current;
Any defects or errors will be corrected;
Our products will meet your expectations beyond what is expressly stated in the product descriptions and our policies.
To the maximum extent permitted by law, we disclaim all implied warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
Some jurisdictions do not allow the exclusion of certain warranties, so the above exclusions may not apply to you in full.

To the maximum extent permitted by law, in no event shall Moodscape Shop (VK Moodscape, LLC), its owners, directors, employees, agents, or partners be liable for any:

To the extent we are liable under applicable law, our total liability to you for any claims arising out of or relating to the Site or products shall not exceed the greater of:
The amount you paid for the relevant product(s) giving rise to the claim; or
One hundred U.S. dollars (USD $100).
Nothing in these Terms is intended to exclude or limit any liability that cannot be excluded or limited under applicable law (for example, liability for fraud, fraudulent misrepresentation, or bodily injury caused by our negligence).

You agree to indemnify, defend, and hold harmless Moodscape Shop (VK Moodscape, LLC), its owners, affiliates, officers, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to:

Your violation of any law or the rights of a third party.
16. Governing Law and Jurisdiction
These Terms and any disputes arising out of or relating to them, the Site, or products purchased through the Site shall be governed by and construed in accordance with the laws of the State of New York, United States, without regard to its conflict of law principles.
You agree that, subject to any mandatory provisions of consumer protection law in your jurisdiction, any legal action or proceeding between you and us shall be brought exclusively in the state or federal courts located in New York, USA, and you consent to the personal jurisdiction of such courts.
If you are a consumer residing in the EU/EEA, UK, or another jurisdiction that provides mandatory rights or allows you to bring claims in your local courts, nothing in these Terms limits those rights.
17. Severability
If any provision of these Terms is held to be invalid, illegal, or unenforceable, that provision shall be enforced to the fullest extent permitted by law, and the remaining provisions shall continue in full force and effect.
18. Entire Agreement
These Terms, together with any additional terms and policies referenced herein (including our Privacy & Cookie Policy and Shipping & Returns policy), constitute the entire agreement between you and Moodscape Shop regarding your use of the Site and purchase of products.
They supersede all prior or contemporaneous communications, proposals, and agreements, whether oral or written, between you and us relating to the subject matter.
